TotMediX Terms and Conditions

1. About these Terms #
Welcome to TotMediX.
These Terms and Conditions ("Terms") are a legally binding agreement between you, the person using TotMediX ("you" or "your"), and Nimah Prime Technologies ("TotMediX", "we", "our", or "us"), with respect to the mobile application TotMediX (the "app").
By installing, downloading, accessing, or using the app, you acknowledge that you have read, understood, and agree to these Terms. We may modify these Terms at any time by posting the updated version on the app and on our website (totmedix.com). You are responsible for reviewing these Terms periodically to stay familiar with any changes. Any such modifications become effective immediately upon posting.
We may collect, use, and share certain types of personal information in connection with your use of the app, as described in our privacy policy. Please review our privacy policy in addition to these Terms. By agreeing to these Terms, you are also agreeing to our privacy policy as if it were repeated here in full.
IF YOU DO NOT AGREE TO ALL OF THESE TERMS, AND TO ALL OF THE PROVISIONS OF OUR PRIVACY POLICY, IN THEIR ENTIRETY, DO NOT ACCESS OR USE ANY PART OF THE APP. IF YOU DO NOT WISH TO AGREE TO ANY CHANGE MADE TO THESE TERMS, OR TO OUR PRIVACY POLICY, PLEASE CEASE ALL USE OF THE APP, DELETE YOUR ACCOUNT, AND DELETE ALL COPIES OF THE APP FROM YOUR DEVICES.
2. The app and its limitations #
2.1 The app is not a medical device and is for informational and organisational purposes only. Nothing in the app is intended to provide, and does not provide, nor does its content constitute, medical advice, diagnosis, or treatment of any kind. The app does not calculate, recommend, or adjust any dose, does not check for drug interactions, and does not exercise clinical judgement of any kind. It records what you or your child's prescription tells it. This includes information generated through AI-assisted scanning of a prescription image, which is provided to help you record information more quickly and is not a substitute for reading and following your child's prescription yourself.
2.2 Use of the app is at your own risk. You should always seek and carefully follow your child's pediatrician's or pharmacist's instructions, directions, and guidelines. Where medical or other professional advice is required in connection with administering any medicine, supplement, or other substance to your child, you are solely responsible for obtaining it separately and independently.
2.3 The app is not intended for use in any emergency or situation that may be considered an emergency. If you believe your child is experiencing a medical emergency, seek immediate medical care and do not rely on the app.
2.4 You are solely responsible for the accuracy of any information you or any village member adds to the app, including medication schedules, dosages, and symptom entries, whether entered manually or through AI-assisted scanning. You agree to review all information extracted through AI-assisted scanning before it is saved, as described in our privacy policy.
2.5 By adding a medication schedule to a child's profile and enabling reminders, you confirm that the schedule was created in accordance with proper medical advice obtained before its addition. A reminder sent by the app does not prevent a dose from being missed, given incorrectly, or given by someone other than the intended village member, and you remain responsible for ensuring your child receives the correct care.
2.6 AI-assisted scanning is an optional convenience feature. You are not required to use it, and every medication can be added manually. Because it involves sensitive health information and processing outside the UAE, we ask for your explicit agreement before your first scan, separately from your agreement to these Terms, as described in our privacy policy.
2.7 We do not warrant the accuracy or completeness of AI-assisted scanning. A prescription may be photographed poorly, be handwritten, use unfamiliar formats or abbreviations, or be written in a language or script the scan handles less well. The scan may misread a value, omit a medication, or be unable to read a prescription at all, and the feature may be unavailable from time to time. Where the app cannot read a value with confidence it will tell you so rather than guess, but you must check every scanned medication against the prescription itself before saving it. If what the app shows does not match your prescription or your doctor's instructions, follow your doctor.
2.8 When you upload a prescription image, you confirm that you are entitled to do so: that the prescription relates to a child whose profile you administer or whose village you belong to, and that you are that child's parent or legal guardian or have their parent or legal guardian's consent. Do not upload prescriptions, medical documents, or images relating to any other person.
3. Eligibility #
3.1 TotMediX is intended for use by adults who are the parent, legal guardian, or caregiver of a child. You must be at least 18 years old, and of legal age to form a binding contract, to create an account and use the app.
3.2 Please do not add information about a child under 18 years of age unless you are that child's parent or legal guardian, or have obtained the consent of the child's parent or legal guardian to do so, including their consent to our privacy policy.
3.3 If a parent or legal guardian believes their child's information has been added to TotMediX without their consent, they may contact us as set out in the "how to contact us" section of these Terms, and we will take steps to delete it within a reasonable time once we have verified the request.
4. Account creation and the village #
4.1 To use TotMediX, you must create an account using an email address, or by signing in with your Google or Apple account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
4.2 The person who creates a child's profile is the "admin" for that profile. The admin has full control over the child's information, including the ability to add, edit, and delete medication, symptom, and vaccination records, and to invite other caregivers to join the child's "village."
4.3 The admin may invite other caregivers to become "village members" for a child's profile, using an invite code generated within the app. Village members must create their own TotMediX account to accept an invitation and join a village.
4.4 Depending on the permissions the admin grants, a village member may view, add, or edit information related to a child's health. The admin is responsible for deciding what access to grant each village member, and for managing that access over time, including pausing or removing a village member's access.
4.5 You agree to use the village feature responsibly, and to only invite individuals who have a genuine caregiving relationship with the child and a legitimate need to access their health information.
4.6 If you are removed from a child's village, or if your access is paused, you will no longer be able to view or add information for that child, but your own account and any other child's profile you administer will not be affected.
4.7 You may delete your account at any time through the app's settings, or by contacting us at info@totmedix.com. What happens to your information after deletion is set out in the data retention section of our privacy policy.
5. Subscription tiers, billing, and cancellation #
5.1 TotMediX offers a free tier ("Starter") that you can use by creating an account. We also offer paid subscription tiers ("Guardian" and "Family"), which provide additional features as described within the app. We may change the features included in any tier, or introduce new tiers, at any time.
5.2 Fees for paid tiers are charged through the Apple App Store or Google Play Store, depending on the platform you use, and are billed at the price shown at the time of purchase, including any applicable taxes.
5.3 Paid subscriptions renew automatically at the end of each billing period, unless cancelled at least 24 hours before the renewal date. Your account will be charged for renewal through the same payment method used for your initial purchase.
5.4 To cancel or change your subscription, go to your Apple ID or Google Play account settings. Cancelling your subscription does not entitle you to a refund for the remainder of your current billing period, but you may continue to use your paid tier's features until the end of that period.
5.5 We may offer a free trial period for a paid tier. If you do not cancel before the end of the free trial, you will be automatically charged and become a paying subscriber for that tier. If you decide to purchase a paid tier before your free trial ends, you will not be entitled to a refund for the remainder of the trial period.
5.6 If a payment fails at any renewal date, we may suspend or terminate your access to that tier's features. Your account may revert to the Starter tier, and your child's information will remain accessible to you as described in our privacy policy's data retention section.
6. Prohibited use #
6.1 You agree that you will not, and will not permit or authorise any third party to, use the app in any way that:
(i) is defamatory, abusive, harassing, threatening, or otherwise harms or could reasonably be expected to harm any person;
(ii) infringes, violates, or otherwise interferes with any copyright, trademark, trade secret, or other intellectual property or contractual right of any third party;
(iii) is illegal, or encourages or facilitates illegal activity;
(iv) attempts to obtain another person's password, account, or private information;
(v) introduces any virus, malware, or other malicious or invasive code, or attempts to interrupt, damage, or limit the functionality of the app or its underlying systems;
(vi) creates a false identity, impersonates another person, or misrepresents your relationship to a child whose profile you access or attempt to access;
(vii) shares a village invite code with anyone who does not have a genuine caregiving relationship with the child;
(viii) deliberately enters false or misleading medication, symptom, or vaccination information;
(ix) uploads a prescription, medical document, or image relating to a person other than a child whose profile you administer or whose village you belong to;
(x) uses AI-assisted scanning for any purpose other than recording your own child's prescriptions, including bulk, automated, or commercial scanning, or testing the feature against documents that are not genuine prescriptions for a child in your care;
(xi) violates these Terms or any applicable law or regulation.
6.2 In addition, except as expressly permitted, you will not, and will not permit or authorise any third party to:
(i) circumvent or disable any security feature of the app;
(ii) sell, rent, sublicense, distribute, or otherwise make the app or any part of it available to a third party;
(iii) copy, decompile, reverse engineer, disassemble, or attempt to discover the source code of the app;
(iv) modify, adapt, or create derivative works based on the app;
(v) access the app through automated means, including scraping, crawling, or bots, except where permitted by standard search engine protocols.
7. Intellectual property #
7.1 TotMediX and all related intellectual property rights are owned by Nimah Prime Technologies or its licensors. Subject to these Terms, we grant you a limited, personal, non-transferable, non-exclusive license to install and use the app for your own personal, non-commercial use. This license does not give you any ownership interest in the app.
7.2 All text, graphics, logos, designs, and other content included in or displayed through the app ("TotMediX content"), other than information you or a village member adds about a child, is the property of Nimah Prime Technologies or its licensors, and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, publicly display, or create derivative works from TotMediX content without our prior written permission.
7.3 You retain ownership of the information you or a village member adds about a child, as set out in the "data ownership" section of our privacy policy. This includes prescription images you upload and the text extracted from them. By using the app, you grant us a limited license to store, process, and display this information solely for the purpose of providing the app to you, as described in our privacy policy. We do not use your information, including prescription images or extracted text, to train artificial intelligence models.
8. Disclaimers and limitation of liability #
8.1 The app is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not warrant that the app will be uninterrupted, error-free, or free of viruses or other harmful components, or that any defects will be corrected. This applies in particular to AI-assisted scanning, as set out in section 2.7.
8.2 To the maximum extent permitted by law, TotMediX, Nimah Prime Technologies, and our officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of goodwill, or loss of profits, arising out of or relating to your use of, or inability to use, the app.
8.3 To the maximum extent permitted by law, our total aggregate liability to you for any claim arising out of or relating to these Terms or the app will not exceed the greater of (i) the amount you paid us in the 12 months before the claim arose, or (ii) AED 100.
8.4 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited or excluded under applicable law.
8.5 You agree to indemnify and hold TotMediX and Nimah Prime Technologies harmless from any claim, liability, cost, or expense, including reasonable legal fees, arising from your use of the app in violation of these Terms, or your violation of any third party's rights.
9. Termination #
9.1 These Terms remain in effect until terminated as described in this section. You may terminate these Terms at any time by deleting your account and ceasing all use of the app.
9.2 We may suspend or terminate your access to the app, with or without notice, if you violate these Terms, or if we reasonably believe your actions may cause harm to TotMediX, other users, or any child whose information is stored on the app.
9.3 Termination of these Terms does not affect our data retention obligations, which continue to apply as set out in our privacy policy.
9.4 Sections 7 (intellectual property), 8 (disclaimers and limitation of liability), and 10 (governing law), along with any other provision that by its nature should survive termination, will remain in effect after these Terms end.
10. Governing law #
10.1 These Terms are governed by the laws of the United Arab Emirates. Any dispute arising out of or relating to these Terms or your use of the app will be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.
11. Changes to these Terms #
11.1 We may update these Terms from time to time to reflect changes in our practices or applicable law. If we make a change that we believe materially affects your rights, we will notify you by email at least 30 days in advance. If you continue using TotMediX after such a change takes effect, we will treat that as your acceptance of the updated Terms.
11.2 If you do not agree to a change made to these Terms, you should stop using the app and delete your account before the change takes effect.
